With reference to our previous notices of the India Regulatory change, the Central Board of Indirect Taxes and Customs (CBIC) has confirmed the Sea Cargo Manifest and Transshipment Regulations to be effected from 1st August 2019. New Update has been confirmed in the meeting of stakeholders with CBIC india last week.

1. Effective date given by CBIC is maintained as 1st August 2019.
2. 45 days (1st August to 15th September) transition period is allowed for stakeholders to fine tune new system and new process. Customers have to provide shipping instruction per new requirement to carriers for the test.
3. Another 45 days (16th September to 31st October) finalizing period for stakeholders to completely run the new system and new process for any necessary adjustment.
4. On 1st November 2019, CBIC and Customs will only accept manifest entirely under SCMTR Regulations without any exception.
5. Penalties varying from INR 50,000 to INR 200,000 will be imposed for any incompliance on or after 1st November 2019.

Sea Arrival Manifest (SAM) – For all containers into India:
1. SAM to be filed in customs before vessel getting departed from Last foreign port of call. Example for Galex westbound, Port Klang is the last foreign port of call.
2. All containers discharging for local or transhipment or retain on board at any Indian Ports.
3. Harmonized (HS) Code of 6 digits is mandatory
4. IEC Code & GSTIN Number for Indian entity is mandatory for manifest & BL
5. Permanent Account Number (PAN) of Notify Party (Indian entity) is mandatory
6. Cargo Invoice value is still being negotiated with CBIC and currently OPTIONAL on SAM and not needed on BL

Sea Departure Manifest (SDM) – For all exports from India:
1. Mandatory rule of Departure Manifest must be submitted to India Customs Prior Sailing of vessel from Port of Loading in India
2. Applied for all containers loaded on said vessel at Indian Ports

1. On long haul voyage more than 4 days – Before 48 hours of expected arrival.
2. On medium haul voyage 2 to 4 days – Before 24 hours of expected arrival.
3. On short haul voyage less than 2 days – Before 6 hours of expected arrival.
4. Carrying break-bulk cargo irrespective of their voyage duration up to entry inward.

For Sea Departure Manifest (SDM):
1. In general not later than 24 hours after departure.
2. In respect of vessels carrying break-bulk cargo not later than 72 after departure
